Hi all,

Ok so I have a few questions about the chomage (geneva specific), and I had heard that this was a fountain of information :)

So questions mainly about:
- how they calculate what you receive each month, and
- the time between being fired and going and signing up. 

Info:
I have worked for for 1 year and 7 months in the last 2 years.

I finished my notice at the end of June this year, and already had a long holiday booked, so without a job, I extended it, as I hadnt ever taken a holiday longer than 2 weeks in my life. (Seemed like a good time, rental contract ended, no job, pro rated 13th salary)

I have been searching for work the whole time since May.

I was on the chomage once before 2 years ago.

So the 3 main questions:
- how do they calculate your monthly? 
is from the literal last 6 months or the last 6 months of work? (so Jan-Jun or Apr-Oct)

- Will I be penalised for not signing up straight away? despite the fact that ive been looking for work?

- Will the punishment be worse the longer I dont sign up? As I assume I will be penalised for not signing up immediately.

I am visiting family in London, and may help my sister with her renovation work (free labour!)

they take your average salary during the last 12 months of employment. they will pay you either 70 or 80% of the amount less social cherges (AVS, etc)

- Will I be penalised for not signing up straight away? despite the fact that ive been looking for work?


normally you are supposed to sign up at chomage from your first day of non employment


but you are supposed to be looking (and able to proove it with copies of letters of application) from the moment you received your notice. also, on the first month of unemployment benefits they will deduct the "delai cadre" which can represent up to 14 days of benefits !! this is not a pnishment, but just a way of avoiding to pay out !!

- Will the punishment be worse the longer I dont sign up? As I assume I will be penalised for not signing up immediately.


you may not be punished ( i've known people who delayed signing up because they were on vacation ! 2 weeks or so ) for chomage it just means that they have more time not to be paying you. the "delai cadre" lasts 18 months ( can be less ) and begins from the moment you sign up and not the time you've been unemployed.


also note, that when you are on chomage, you haven't the right to leave the country on holiday etc. nor, are you allowed to take any courses during the working day time period ( 8am-18:00) as this is considered the time you should be looking for work. holiday time is based on the number of days you are on chomage ( usually x days per month of chomage once a year)


learn the rules ( your rights and obligations ) and you can come out of this a winner ( get your chomage paid, some educational courses paid, keep this going for 18 months and have a new job at the end :-)

In that case I will probably stay and help my sister for a month.

The main issue was whether it was calculated by last x months or last x months of employment. As that would really make a difference.

hi jessica,
it would be best to sign up now at chomage, and start getting paid. you can tell them you are looking for work in the UK and will go there for approx. 1 month. as long as you can show that you are looking and applying for jobs, they normally would allow this.
just my advice knowing the attitude of the chomage office, they will look for ANY excuse to not have to pay you. but, if you know the rules, you can be the winner :-)

question. I recently lost my job due to not attending following a warning and my dismissal later stats this. Will this mean I cannot claim chomage? I've heard it could cause a 3 month delay?

if you were dismissed for having not complied with instructions after a warning, this may be considered by the unemployment office as your fault and reason for your dismissal. in that case you can be penalized up to 30 working days (1.5 months @ 20 days a month), however you can always appeal the decision. remember you also have to have contributed as an employee to the chomage fund during at least 12 previous months.

They ave lawyers and they can guide you . I have been helped and guided by their office in Lausanne.

The Association de Défense des Chômeurs definately can guide and help; here in the Geneva office you need to speak and understand reasonably good French.


If you call they can give you an appointment that lasts as long as it needs, up to around 1h30. It is at no cost either, there's a donation box at the entrance.


In the Geneva office, it is not a lawyer they have, but a juriste, who is just as good really as he is specialised in "droit du travail" and all issues related to chômage, as are his collegues who have a different function.
