The best strategy to get back security deposit

We are about to move back to US and are a bit overwhelmed by all the stories from people who have trouble getting their security deposit back. Our leasing company is notoriously known for not being very nice to their tenants.  Our security deposit is worth  10,000 CHF. A Swiss friend recommended not to pay 3 last months of rent and have the leasing company use the security deposit to cover the outstanding rent. Is there a catch? Can it cause any legal complication?


Any help/advise will be greatly appreciated.

As long as you have the apartment in the state it was received....you should be fine receiving your deposit.

In Switzerland, the régie does not hold your deposit - it is held in a bank account under your name that is "blocked".  This means that if you leave without paying the last few months of rent the régie will be obliged to get a court order from a judge to release the account in their favour.


I imagine that all these legal costs will be charged to you.  Also, you will be on file as a credit risk and as a bad payer.  If you ever return to Switzerland, these outstanding debts may need to be reimbursed and you will have a lot of problems renting anywhere.


The behaviour that your friend suggests sounds very dishonest to me.  Also, it will only add to the régie's reluctance to rent to foreigners.
