Applying for Regroupement Familial - Inside Geneva

Hello all,


 


Me and my wife are in a delicate situation and would like some advice and if someone has experienced it before.


We are both non-EU


She has a student visa (B), that will go until September but can be renewed.


I had a student visa until March, but now I am back with a tourist visa.


 


The reason I am with a tourist visa is quite simple. I was about to start working on another country while she would remain in Geneva to keep studying. This would last for a few months. 


I got back to grab some boxes to move to this third country. However, while I was here, we discovered that she is pregnant. More than this, her pregnancy have not been easy and she needed a lot of my care.


My tourist visa will expire on the end of June and she still need me by her side. I decided to stay.. or at least try.


I want to apply for a spouse visa but I heard that they ask that it should be done from the country of Origin. If I would go back to my country this would be very costful and it could take weeks while I am far from her.


Therefore I want to apply for the spouse visa while in Switzerland


Has someone experienced this or know someone with similar story? Do you think that they could exceptionally give me this visa?


 


Another fact is that I lived in Switzerland for some 2.5 years and would need to ask for attestation du casier judiciaire from here so this could weigh in my favor.

Brazil has entry into EU 



3 months during a 6 months period following the date of first entry in the Schengen Area

Considering this fact u can take decision how to manage. Also students have option of paying health insurance of chf 80 per month with chf 300 franchise and all expenditure is covered.


Switzerland is one of best country in health care.

why don't you go and ask straight from the immigration office (OCP-Geneve). You have a good poissiblity of getting a tourist visa extension. if you can prove you have enough funds to support you and your wife and she really needs you to stay here. Btw "you just heard" that you need to apply for the visa for the spouse from country of origin. Make it sure.

In fact the OCP website says `Une demande de visa doit préalablement être adressée auprès de la représentation suisse du lieu de résidence des personnes concernées par le regroupement familial.`


 


However, our residence has been Switzerland since 2015 (for me) and 2016 (for her). If they consider my residence Brazil it would take a long period, which I want to avoid.


 


Anyway, I am willing to ask OCP. IT would be good, though, to hear if someone else has been through a similar case.

I would suggest that you contact an immigration specialist. Sometimes, it could be possible to negotiate that you pick up the immigration visa in another country, for example Paris instead of in Brasil.
