Do I need to pay additional taxes for the time when I was unemployed?

Hello,


I have a question regarding taxes.


During 2010 I was unemployed and on chomage and actively searching for a job. I was shocked to receive  a letter from fiscale cantonale later in 2011 asking me to pay signficant amount of money (6000CHF) as additional tax for 2010 when I was unemployed. I think that this must be a mistake, because all year 2010 I was searching for a job and paid taxes through chomage office. I have paid all the taxes correctly on monthly basis from my chomage salary.


Is salary of chomage like a normal salary with all the taxes included? Should salary from chomage already include all the taxes? Is that correct that cantone fiscale is asking me to pay additional money for the period when I was unemployed? I did not have additional income, just a monthly chomage salary.


If anyone knows how this should correctly work in cantone Geneva, please get in touch with me.
 
I simply dont want to pay so much money for something I should not pay and feel that something is wrong when a state gives you a support (which is already taxed) in your unvoluntarily unemployment period and later asks you to pay additional money on the top of it. Is that correct or wrong?

You mean to pay additional taxes on taxes I have already paid in my chomage salary? What sense does it make? Why the cantone or state did not take it directly (I was on tax a la source) from my chomage salary? What sense does it make to give you a support and later to ask you to pay some of it back...?


Maybe there is a law for this, but it simply does not make sense to me. It does to you? Thank you for your reply in advance.

Thanks, Reka, here is what I was told:


Chomage is a normal salary, as you work full time looking for a new job. Do do your research, plus every month you meet your councelor to discuss the progress, etc. You get less money then before - when working - but it is all regularly taxed. When working, you pay your insusance tax for a potential situation if you loose a job in the future. If that happens, state gives you a support (alreardy taxed) in that period, and then later comes to ask you to pay extra tax on what has already been "given" to you... I just does not make sense to me...:-)

If you're normally taxed at source, your allocation de chomage should also be taxed at source (barème D, 8%), at least that's what they say here: http://ge.ch/impots/taux-dimposition-la-source-pour-les-cas-


So basically you need to know whether you've been taxed at source (in which case you should have paid everything) or not (in which case you do have to pay your taxes on allocations de chomage). You should probably be able to find whether or not your chomage has been taxed at source in your chomage papers. Otherwise just go and ask them.

you may also ask to fill out the normal tax declaration. then you will see what you have received as income and what you have already paid as tax, and with your deductions ( travel for work, meals outside the home etc.) they may be giving you something in return. tax at source, is always based on the full amount of tax to be paid, without any deductions calculated. therefore it is always better to fill out the tax form rather than just accept the "at source" deducted from your monthly salary. you can find the tax form on line.

thank you.


I have B permit, so I was taxed a la source. This is very important for me to understand - when I was employed and when I am employed now, I was and I am always taxed a la source. When I was unemployed, I was also taxed a la source (did not have to do the declaration as it was always done with my employer or chomage).


Where is that writen that when I am taxed a la source during chomage period, I should not be asked to pay some extra tax later on the top of it?

thank you for your reply. I am a la source tax and my question is whether I can ask for the "normal tax declaration" with my status (permit B). That is clear that it will always come better, if you can deduct travel, meals, etc.


My original question was more rather to whether if you are taxed a la source during your chomage period, should this tax be final, or can fiscale cantonale ask you later to pay additional extra tax on top of what you have already paid a la source? That is my core interest to know and find it somewhere written..

Jan, in your situation the best thing is to go to the Hotel des Finances in rue du Stand and explain your case to them, they should be able to sort it out.

did you ever get resolution on your tax situation. My partner is facing a similar tax bill from when he was on chomage in 2012
