Marrying a non resident - Now forbidden! This is against human rights!

I see on the Geneva canton website (Office de l'etat civil), that they will no longer let you get married unless both parties can prove that they are holders of Swiss resident permits, (permis de Sejour).  


It looks like the intention must be to stop illegal immigrants from marrying.  This must also catch thousands of people who planned to marry staying within the law.


This seems to mean that a fiancé can not fly in from say India, Canada, USA, or Australia, on a tourist visa and get married to a Swiss person.


What about if one partner lives outside Switzerland but has a Shengen visa, e.g. for France? 


Can residents of other EU Countries marry here?  Can a French resident marry in Switzerland?  What about a UK resident?  Can he marry in Switzerland if he does not have a Permis de Sejour?


Is there a way around this if the person can't get a permit for work or study in Switzerland.  Does a "marriage" permis de sejour exist?


Are there any immigration lawyers out there who can give some tips?

Thats not how I read it... it seems to me that Switzerland is simply not a destination to get married if you "both" dont live here (ie its not a beach in the Bahamas)...


A resident marrying a non resident... that doesnt seem to be an issue. Plus fiancé visas are still issued.

Ils pourront être informés et conseillés en particulier sur les questions suivantes :



obtention des documents nécessaires relatifs à leur identité
déclaration sur la réalisation des conditons du mariage
la formation du nom après le mariage

Les fiancés doivent collaborer à l'établissement des faits.

Indeed, there is a new law since January 2011, a man who wants to get married with a swiss girl or vis versa must have a permit of residence (info toward Office de la Population) otherwise they have to get married in the man or woman's country, then the Swiss national must come back and do some necessary process to bring his wife/ her husband in Switzerland.


Geneva's Canton is one of the last who get into this system, all the other cantons get into it from long time. This helps to avoid white marriages which were very frequent here.

If the stores on EF are accurate, getting married in CH involves a ton of paperwork.  Half of that paperwork will have been completed incorrectly and will require resubmission (in spite of the applicant's best efforts).  The other half is information from the soon-to-be-wed's home countries which can be next to impossible to obtain.  It seems like a lot of headache can be avoided by getting married somewhere else.

 It is taking at least 2 months to have all your marriage papers settled here (without talking about waste of time cause of papers incorrectly filled out).


The longer is that you have to send your birth certificate to MFA or MJP to be legalized and it takes long too!


But for people from the Schengen aera I am sure that things are simple and faster.

because if you have to jump through all the hoops in switzerland, divorce may be not so far off......it can be a real test of teamwork, patience and desire.

Wow, this is terrible experience! Ok so good to know... I knew that the permit of residence here in Switzerland is a must for getting married, but this is very strict for people from the Schengen area...


I had to deal with some people cases running and stressing all around the city tp get there paper settled before the new law pass,but i was too last for them anyway...


Unfortunaltely that's sad for the REAL couples who really want to get married, they are mixed up with the fake ones who just try to settle their situations by becoming legal or getting the opportunity of staying here, everyone is involved in the same bunch.

A part of the wedding case, Schengen agreements is not a such a bad idea, it stops some abusive uses but brings pros & cons too...

Yeah too much hassle to get hitched in Geneva! As both my husband and I are not Swiss nationals we would have had to spend weeks on end waiting on legalized documents from Brazil! Instead we opted for a wedding in Brazil and because we had little time there we paid a little extra to the registry office to be moved up the line Wink....
