Bad experience on Ricardo - not their fault

Having received very mixed reactions elsewhere, I am interested in Glocalers input to the following :

Regrettably, first really bad experience on Ricardo. A seller in Kerzers insufficiently packed a stone-topped raclette grill and when it arrived, the top was broken in two. Immediately sent a photograph and asked for a refund. As she had 100% positive evaluation, I wrote and said it would be a pity if negative evaluation was given for the first time {by me} so if she would refund the whole amount, we would even give her positive evaluation and everyone would be satisfied.
Long story short, it turns out she is a policewoman : she wrote a hugely long email saying "blackmail is punishable under Swiss law up to 10 years in prison, even if it is only for CHF10.--"! She even copied in her work place, being the Polizei Kt. Bern.
Firstly, we would have thought the Polizei Kt. Bern had other things to worry about {well, we hope they have} than 10.-- worth of Ricardo goodies and secondly, is it not frowned upon to use one's workplace email address for personal transactions on Ricardo? To add insult to injury, the woman has now retracted her positive evaluation [which I was totally unaware that one could do] = this presumably in a fit of spite?

I have not responded further to her mail, nor yet given negative evaluation.

What do you all think please?

Thanks for the support guys. Just goes to show what a police state CH is still.

I mean, this is ridiculous nonsense for 10.-- bucks on Ricardo for heaven's sake!

Do any of you know what this email address indicates - it's her work place?

Sie können mich auch im Geschäft unter: [email protected] erreichen

police.be.ch is the Bern cantonal police. What that is saying is

You can also contact me in the business under: reach [email protected]

so I would assume she is using her work email ....I would also assume she shouldn't be doing this in police time ??

My only thought about that is that I'm not sure the Berner Kantonal Polizei would be very happy with somebody using its professionnal adress for such purposes.

Other than that, here is what the law actually states:

Art. 156 (Swiss Criminal Code)

Extortion

1.  Any person who, with a view to securing an unlawful gain for himself or for another, induces another person by using violence or the threat of seriously detrimental consequences to behave in such a way that he or another sustains financial loss is liable to a custodial sentence not exceeding five years or to a monetary penalty.

2.  If the offender acts for commercial gain, or if he repeatedly commits the offence against the same person,

he is liable to a custodial sentence of from one to ten years.

3.  If the offender uses violence against another or if he threatens another with an immediate danger to life and limb, a penalty in accordance with Article 140 hereof is imposed.

4.  If the offender threatens to endanger the life and limb of a large number of persons or to cause serious damage to property in which there is a substantial public interest, he is liable to a custodial sentence of not less than one year1.

I doubt that anybody will consider a bad evaluation as a "seriously detrimental consequence" not to mention that you are not trying to secure an unlawful gain. On the contrary unless there is something different in the contract the Code of Obligation states:

Art. 197 (Swiss code of obligation)

III. Warranty of quality and fitness

1. Object of the warranty

a. In general

1The seller is liable to the buyer for any breach of warranty of quality and for any defects that would materially or legally negate or substantially reduce the value of the object or its fitness for the designated purpose.

2 He is liable even if he was not aware of the defects.

Frankly if I were you I would just let the 10chf go and give her a bad review.
