I found an apartment and agreed with the rental company a fixed contract of 3 months and that I could renew each month afterwards only having to cancel with 1 months notice.
When I recived the contract it had a bail take-over notice in the contract for for 1 year from June 1st 2019 - June 1st 2020 in the contract. And the actual bail has a take over from June 1st 2019 and no end-date on the bail.
I refused the contract based on this. As I have a short-term working contract here and possibly will not be in Switzerland until then.
When I refused the contract the rental company claims that I have to pay rent for compensation of loss for renting out to other tenants.
I recieved the contract on May 20th and refused on May 22th.
I have seen that the rental company have now made a new advert about the apartment. But at a higher montly price for the apartment.
Are the rental company allowed to claim rent from me when the contract had new information about a 1 year bail that had not been communicated?
The company claimed to have other applicants for the apartment and others who wanted to see the apartment. In my view I am entitled to refuse the contract based on new information not communicated. And that they would have to prove that they could not rent it out to any of the other tenants.
