Gerance charges me extra -for paying my bills at post office!!

Anyone had this experience?


I pay all my bills in person at the post office( old habits).Have always done so without problem.


this year,I get a bill from the gerance charging me a fee for each bill I paid in at the post office.I contacted ASLOCA as I suspected this was not legal.


My gerance recently sent me a bill charging me a fee for each bill I have paid for my rent at the post office( I have always paid my bills at the  post office - my choice and my right)I felt this was not right and contacted ASLOCA.


ASLOCA said I should send back the bill telling them the practice is illegal and not in the Code des Obligations.


i did this,but they wrote me a long   letter using legal- type language,justifying their charges.Then they resent me the bill.


 


I don't want  a big fight over a small bill BUT it is the principle that bothers me - the gerance forcing people to do something when they have no right to do so,and using language to imply that they have the legal right.


Anyone have any knowledge of this type of practice.....and advice on what to do next?

It's not a small thing at all. It is worth it to pay an ASLOCA lawyer to send the regie a registered letter citing the specific code of obligations. if your regie does this, they'll do anything. 


Make certain this is done by registered letter and keep copies.

At least for rents, this is not usual, but not unheard of. The Code of Obligations IMHO does not contain an anwer to your question, but the landlord could include such an condition in his contract. One example I found was:


"Post office counter cash payments are causing fees at the expense of the payee that will be reclaimed from the tenant. In order to prevent from getting charged at the end, you have to add CHF 3.- to the payment."


If he has not, I see little chance that he could win in court.

It is becoming common to pay extra for paying AT the post office.


However if you pay the "pink PTT form" by E_Banking there is no extra charge.


(You pay only the figure on the PTT form)

Then can not charge oyu fees for receipts from any financial institution, unless they receive less than the rental amount contracted. So did La poste charge a fee for the payment, if so, it shoudl be on the receipt you received when you made the payment? Or if you have an account with La Poste then make sure all charges are paid by you. because payments are made with 'All charges paid by you, yours/mine, theres paid by themselves. This is usually a check/tick box on the Giro/Bulitine du versement. Again, your not responsible for there bank charges at all.

Dave, I don't think, that the information you give is correct.


On page six here, the costs are clearly listed. So if you have a red credit slip and pay CHF 1'800.00, the fee is CHF 3.55. This fee is not shown to you, but the payee does not recieve the full 1'800.00. These fees are only due, when people pay at the counter at the Postfinance.


And after a brief internetsearch, I have found no indication, that the payer has to cover those fees, except if such a rule is part of the contract.
