Hiring someone from abroad

Hello All,


I am trying to hire someone from Egypt. I have contacted the OCP and I can fulfill all their requirements. The only thing which is giving me problem is the "les preuves des recherches effectuées sur les marchés du travail suisse et des pays de l'UE/AELE" Which means that I have to provide a proof that I couldnt find the relevant person in CH and UE. Has anyone done this before? Any suggestions and guidance will be greatly appreciated.

This is because of the high % of people on chomage in Geneva. Understandably they want to hire locals on chomage 1st to get them off the chomage. 


Le chômage augmente en janvier à Genève

Le canton compte 208 chômeurs de plus en un mois. Le taux de chômage s'établit à 5,7% (+0,1 point). La moyenne nationale se maintient à 3,5%.

Thank you Valerie. I can do that for the swiss market. Now I need to figure out how to do that for UE/AELE market. Does anyone know of a website or something where jobs for the whole of UE/AELE are posted? Any advise on that will be really helpful.

My interpretation would be that from the candidates who have applied to the position (after  you advertised it publicly), nobody from the CH or AU/AELE fit the bill. What I mean is that nothing prevents Europeans to check websites such as indeed.ch. In fact, they would be expected to do so, if they wish to work in the CH.

Hi Nasrin,


This should normally only work for qualified specialists (to be hired in a relevant position).


It is compulsory to advertise the position via the "ORP" website for a minimum of 4-6 weeks. When doing so, just request the position to be also advertised on "EURES" (European equivalent).


To prove that you couldn't find a suitable candidate in Switzerland and EU/EFTA, you will need to advertise the position via other channels, too, and provide evidence to the authorities.


You will need to keep a record of all applications and detail the reasons why a candidate was not suitable.


@Oonagh: This has nothing to do with the job situation in Geneva, this is based on federal law and directives.

Hi Nasrin , 


        I think its better for you to  see a lawyer , so that he can give you the regal aspects , and how you have to approach . When we want to hire someone from the non EU . will be  bit complicated .So Instead of giving you suggesions , I prefer  if  you to go through a good lawyer (and there are many in Geneva) will be more evident .It because they know how we have to approach , and  as per which law article  etc . Because the same happened to a person whom I know . So I wish you all the best

Good luck. That is the only requirement that is nearly impossible to fulfil. The person has to have some super skills that no one has and with unemployment like it is, it is nearly impossible to find this.
