How to get back my deposit?

Hi everyone,


I'm wondering if anyone can help.


I moved in an apt this past monday, but it's a nightmare.


So i did find another apt to move in either this sunday or march 1st.


The problem is that i gave a month deposit+one month rent , 1800 swiss francs to the other person (the nightmare one), for 1 week stay so i was wondering if there is any way that i get the deposit back?

Jennifer,


Did you sign any conttract? If so, check if what it says about getting your deposit back applies.

Hi Pascal,


no, i did not sign anything we were supposed to do it this week. but i really do want to move, i can't sleep because of the mess she makes. she is the landlord, i mean according to what she says, but she told me a lot of things that are untrue that i'm wondering who she is what she does.

i agree with the notice thing, nut we didn't isgn anything. do you think that might get worst

Here is what I would  recommend:


1) Write down everything you can remember and document about dates, oral agreements, and details about what you and she discussed;


2) Find and make copies of any receipts you have for money you paid her, including rent and security deposit;


3) Write down all the problems you have encountered in living with her and state clearly why you can no longer reside there.  Make particular note of any situation that affects your health and employment.


4) Join ASLOCA, the renters' association and get professional advice.

Jennifer, I know it might seem like a mess now but you will get out and you will get your money back. I have been in similar situations a few times. Sometimes people say they own it, sometimes they don't. You are probably paying much more for the apartment so she cannot risk going to court because she is the one who will lose. Furthermore, I am sure the regie or even the real subletter don't know about you either. So she wouldn't want to risk that either.


Don't let her even think she can keep the deposit and demand the rest of the money from this month. It obviously sounds like it's not the deal you thought you were going into. You haven't signed anything - just repeat that. And don't leave till you get all your money until the last cent because you will. Just be more assertive and say you would take legal action if all else fails. 1800 when you are sharing is much more than what the apartment costs and a subletter is not allowed to sublet it for a higher price than the regie price. In her case she might not even HAVE the right to sublet it.


So keep your head up and move out
