Is it possible that the Swiss system doesn't work? Apparently YES!!
Hello to everybody.

I have a huge problem and I need some advices on how to solve it.

A man pushed my scooter (bought 3 months before second hand) by car when I was not there making a big hole on the side of the scooter and many little scratches on different part on the same side. He left a note with his number and I contacted him. Basically he wants to pay me just for the big hole because he thinks I made the other scratches before by myself, but it is not true. I did an expertise at the garage and they have estimated around 3000 CHF. He wants to pay just around 400 CHF for the hole.

So I decided to go to the police after a while trying to negotiate with him and they said that I can't do anything. I can try with the "procurator general", but it sounds like something that would take years and years! My insurance is also not helping me because I don't have a "casco totale". Now I really think there is a big hole in the Swiss system because apparently I have no right to get my scooter fixed.

Does anybody knows a way to solve this kind of problem? I'm really depressed at the moment and I really need an advice...

Hire a lawyer, and get the lawyer to contact the guy. In most cases, the fact you're ready to hire a lawyer will signal to the other side that you're serious about this, and they'll be far more open to talk.

This is an ideal example for when a legal protection insurance would have come in very handy. Would have cost you around CHF 200 for a year, and would have gotten all the legal help you needed.

Seperatly, how can a few scratches cost CHF 4000 to fix? Most scooters cost CHF 4000 new from the store...Maybe get an estimate from another garage?

Thanks for the advice. It sounds something that can help me.

I know that it's really expensive. The problem is that my scooter is a Suzuki and that is the only garage that I know dealing with suzuki. I already tried to go to another one but they told me to go to the Suzuki place where I went before.

Tomorrow I'll try to call them.

Cheers

It's true the Swiss system is a beaurocratic nightmare, another angle you can take is filling out a constat d'accident, which is a blue form you fill out after an accident, fill out your part stating what happened then take it to the person responsable for the damage, if he won't fill it out, then threaten him with legal action. You can then present this to your insurance who will contact his insurance, then the two insurance companies will battle between themselves, and it will be the insurance of the other guy who pays for the repairs, or they will pay you the value of your scooter to replace it.
