Juridic insurance: potential complaints before UNAT and ILOAT

Hi,


I am looking for judiric insurances that do not exclude coverage of complaints against international organizations before the United Nations Administrative Tribunal or before the International Labour Organization Tribunal. But I have not been able to find any...

as far as i have seen, most of these don't cover any litigation that you bring forward, only cases where you are the one being accused. and, they don't cover you for cases that you have not brought to their attention beforehand. the one i have, "Fortuna" has not acted on my behalf at any tiime when i asked them to in the 4 years that i've had the insurance.


however, they do reply to all sorts of questions over the phone regardless if they cover you for the case or not.


well, for 274.- sfr. a year it may well be woth it, as you know you have advice!

Why don't speak to Fanny Delatour at Allianz ; she often advertises on Glocals, or you can contact her on 058 357 7827. She is full of resources and deals with expats and high end customers on a regular basis.

check with your staff council they may have some money set aside to assist employees in bringing claims to the UNAT or ILOAT

Many do--you just have to get it expressly in writing from the company that it will cover a dispute that may only be litigated before the ILOAT of UNDT/UNAT.


The ones the absolutely offer such coverage are, even when you are the claimant:


Fortuna- CAP-Alliance


Helvetia (COOP)


Orion


Axa-ARAG

In several cases, I know that Touring Club Suisse (Assista--full coverage, not just the traffic policy) has covered such claims, but need get it in writing in advance.  If the general conditions say that it only covers claims that can be brought before the Swiss tribunals, that means it does NOT cover claims in the ILOAT/UNAT system, unless the company expressly agrees in writing otherwise.  Generalli also offers reasonable legal insurance but not sure if it covers IO employment claims.


Bottom line is that anyone living in Switzerland should have a legal insurance policy whether you work for an international organisation or not--if you screw up, or have a fender bender or a scrape with your neighbor, you quickly find yourself in a powerful and expensive legal vice--as the minimum hourly rate for lawyers in Geneva is CHF 400, and as such policies cost  between CHF 250-400 a year, its a no brainer.  This is also true because when you sue or get sued in Switzerland, the loser pays the other side's legal fees--such insurance policies also cover that exposure as well.  And you can't buy it once the claim arrives!!
