Kicked out of Switzerland?

I have a question to pose about overstaying the 90 days an American tourist is allowed. I stayed 101 days by accident because I was trying to book the cheapest flight home to the US and forgot to count the days. It was an honest mistake. I have heard of plenty of people overstaying their time and getting through customs fine or just being yelled at a bit so I was not too worried. However when leaving through Zurich I was pulled aside, given a 230 franc fine and told that a judge would decide if I was allowed back into the country. If I am not allowed back I am banned from Schengen areas for 3 years. I have called many people in the Swiss embassy in the US over the past few days and have been unable to get any solid answers. I would just like to know the following: 


1. Has anyone else heard of this happening before? 


2. When will I find out about my refusal of entry? 


3. What are the chances that I will be allowed back into Schengen areas? 


4. How can I appeal this process if I am prevented from entering? 


5. Does anyone have any contacts they can suggest or advice to offer?


I miss Switzerland and want to come back! Thanks in advance for any help!

If your embassy can't answer these questions, I don't think you will find much luck here.


Next time take a trip to Morocco or something if you can't make it back to the States before the 3 months are up.

Hi,


Well, most of the punitive actions following on such an offence are usually designed along reciprocal lines. Just find out what actions the American authorities would take against an Eu citizen in the same situation, and you will know what to expect.

The last time I left La Suisse I noticed that they have definitely ramped up their procedures.  A lot of others were caught off guard and did not have the proper documents with them.  I saw a student get pulled aside for further inquiry because she could not produce something they asked for.


It used to be you just left and they barely cared or looked at anything. Now, they review your passport, ask what you were doing, ask for your cart de legitimation, etc.  My guess is that it is part of joining the Schengen system.  It will definitely make it harder to stay unless you have good reasons to be here.  Before, I imagine a lot of people got away with overstaying left and right and had no issues.
