No papers because of the consulat!!

Hi!


 


I would like to know where to go here in Switzerland, if the consulat cannot help me as it should? Which is the next and higher institution who can stand for the foreigners?


The story is: 4 months ago I asked for the recognition of my marriage with my new name at the consulat, and with that for a new passport instead of the expired one also with the new name. (I have to prove with the passport in Switzerland the name also in the Permit) .I paid and they sent the documents to my country. They said the procedure is 3-4 months.


Now we are at the end of the 4 months and I asked them where are my papers? They say they try to reach the hungarian side of the case, but they cannot do anything because they do not listen to each other... 


Soon I am here with a baby without any hungarian papers (because my passport is expired and they took my ID card of course) to prove his origin, and I cannot travel neither.


SO who would be the competent at the next level to help me with this?

It is them, in Berne, who are not able to handle the case.


I have to get in tounch with the Hungarian Ministry of Foreign Affairs... when they SHOULD! This is their job. I have to find a solution. All hungarians and hungarian institutions are INCOMPETENT!!


The same happening always when i got in contact with them (bank, school, government). They never know anything or giving false answers and informations. I am ashamed to have this nationality, that s why i try to cut every single line with this country!


Sorry... i know this is my personal problem, but they make me crazy every week with something...

Hello Gina,


Being Ukrainian I perfectly understand your feelings and despair about the mess in the authorities which are actually created to sort out our problems and not to multiply them...


So what I would consider if I were you, I would insist on getting a personal appointment with your mission head in order to discuss your case personally with him. There is no chance that the embassy can leave their citizen without any valid document (national passport or ID) or at least any document temporary replacing it (official letter confirming your personality and the fact that your documents are under rework now within the official hungarian authorities). This document should be enough for you to travel and also for future recognition of your baby's origin. Again - if I were you, I would not leave the embassy without getting such a paper which is a proof for your citizenship and current status (they do issue some temporary docs for people lost their official documents and so on, so it should not be an issue). Also during the discussion with the Hungarian mission head, I would request the official confirmation for the standard duration of the procedure for issuing the new documents, and in case if it is already bypassed, you have a full right to raise a written claim explaining the situation you appeared in and asking them to provide you with official respond about your case and its solution. As any other bureaucratic organization, the embassy will always react more seriously on the official written claim than the phone call. Finally you can also remind them about the constitutional rights guaranteed by the state of Hungary both to you and your child and maybe scare them a bit by the fact that you can contact some organizations taking care of human rights just to demonstrate your case as an example of how the woman and a child are treated by the embassy of Hungary in a basic bureaucratic situation like processing the name change after marriage and issuing a new passport. Otherwise I am afraid that there is no other organization but your embassy which is able to solve your problem (as far as I understood traveling to Hungary is not an option for you).

Or you could also say that you are going to the press because you are so frustrated and with their lack of action - that should get them moving. No government organisation wants it's name in the newspapers for lacking in what should be their citizens' rights.

Thank you for the tips. I will try to have an answer from the ministry of foreign affairs first, and after i am going to search for my written rights. The press is the last thing what I would do if really nothing works.
