Taxes in Geneva, where?

Hi, I have moved to Geneva and need an advice. I have just signed the contract that main tax idea is in this point:


'


a)      The Employee is solely responsible for paying his social and income taxes. Employees will be obliged to pay income tax in their country of residence.


'


Have ever seen or have such a point in your contract?


Where I should go to consult that in Geneva? Do you know where is Inland Revenue in Geneva? Do I need to get status of resident, where?

Sounds like a sub contract relationship rather than employed, or with an employer that is not based in Switzerland


Reka is right, if it is a true employed position and the employer is in CH, all the obligations fall on them, not you

Hi, thanks for fast response. 


My employer is on Cyprus- Larnaca.


The are paying me gross and said that I need to take care of taxes 'in the country of residence '


Any idea how it works?

Hi Karol


Not sure about Canton Geneva, but if your employer in Geneva isn't doing it, you have to separately not only pay Swiss Taxes yourself, but also all required contributions to the social schemes in Switzerland which include unemployment insurance, invalidity insurance, second tier pension (if you want, which also provides, added invalidity and life insurance), and maybe some more contributions.


To file Swiss taxes for 2013, you have to complete this my March 15, 2014, and pay any due taxes. If you are taxed at source then you put down what youve paid I guess and either pay and additional or get a refund I guess.


I am not an expert, so there may be more, but it's a start!

I'd you  to get some professional advise. Look for a "fiduciare" - because these kind of things can get nasty if you do it wrong. Paying a couple of franc might save you a shit load of money in the long run.

If your Cyprus 'employer' has a project contract with the geneva client with guarantees, deliverable and control over your work .. then you can be treated as an assigned employee, by the social charge authority (google AVS), and all is good.


If however they are putting you at the dosposal of a client in Geneva, (who will direct and supervise your work etc .. ),  then they are putting you and the client in an awkward position because this is a licensed activity which requires a base within Switzerland. it is this base which should take responsability for your taxes and social charges.


If the Cyprus company is a recruiter then i can refer you to a licensed payroll management company and the parties should accept this.


If the Cyprus company is itself a payroll management company .. then frankly both you and the client should question whether this is being handled properly

I think you should get some legal advice asap.  Try the “Permanence juridique” in rue Verdaine for a first consultation, which will cost something like CHF 60.  It will be worth it for your peace of mind.

Hi,


The main idea is that I have nothing to do with Geneva :) I dont have any customer here that I work for.  


My employer doesnt care right now where is my 'country of residence'


My fiancee found job here and we moved here. My employer told me that if I would like to work remotely I need to switch to 'Cyprus contract'. Thats it.


And the 'Cyprus contract' says that I need to pay the taxes in the 'country of residence'. So if I move to Ferney Voltaire or other European city I will have to pay taxes there.
