sous-location - notice period

hi everybody.


I've been renting an apartment under a sous-location deal. The contract is for 2 years and there is no mention of early termination. I know, it was stupid of me to sign something like that, but I had to find something quickly.


Anyway, only reason for early termination by me is :a) lorsque la description des locaux ne correspond plus à celle de l'art. 1.


I am not even sure how legally binding this kind of contract is.


Would you have any info and/or tell me who I could contact? I think ASLOCA is not for sous-locataires.

PS I cannot ask my landlord as he's very moody and might just throw me in the street, he's threatened that before.

Try not paying him, then he will send you an eviction notice, you accept it.. and pay him.. voila...early termination.

in all seriousness, asloca deal with sous loc as well... plus you have a right to terminate, its normally at quarter end with a months notice for proper rentals. 


Its unlikely if you give notice youre leaving he will be able to enforce the 2 yr full payment. 


The deposit might be an issue though if you paid one. (if you did, say 1 or 2 mths advance, then thats your effective notice).

I agree with the above but it also depends upon how much security deposit you gave him. Yes, ASLOCA is for sous-locataires as well...and if he sublet the apartment without the accord of the owner or regie, he could lose the lease.

Thanks guys, I will also ask asloca, then.


I gave him 2 months deposit and asked for the regie to be notified. Whether he's done it, not sure.


Thanks again, I've rented apartments in many European countries and CH is the hardest so far.
