who pays if somebody breaks into a mailbox?

Hello


I am desperate! Sombody broke into my mailbox and mail was stolen. The regie organized sombody to repair it and said they will send the bill to my insurance. However my insurance informed me that the regie is responsible to pay (there is a binding precedent which says that the regie has to pay they say).  But, of course the regie does not want to pay and says simply - no. 


Does anybody know who is right?  I start considering paying  the 100 CHF on my own just to avoid troubles.

If you need professional advice, try one of these:

30 minutes of advice at 50 CHF. They are available from Monday to Friday 7:30 am to 9 pm - but you need to ask for an appointment. 



Or you can get free phone advice from the DAS Insurance, even if you aren't a client of them (but I suppose you will afterwards end up in their "basket of potential new clients") :-):

Thanks a lot for the links! I will go to the police tomorrow to denunciate the destroyment of the mailbox, my insurance asked me to send this together with a letter from the insurance to the regie. I will see how they react. And I will get some advice from the links you suggested Smile

this seems to be a problem between the regie and the insurance.....so let them sort it out between them. if you get it changed or repaired and you  pay the bill, seems to me that at that point, both the regie and the insurance company are off the hook. i would leave it to them to sort it out. for example, if the lift was vandalized, would you ( as you do use the lift) pay to get it fixed? i think not. the mail box is not your personal property, but is the building owner's property....and problem. just my 2¢

I had this happen in Vaud. I contacted the regie and they sent me a bon to contact a company who came and fixed it.  I did not pay anything.  I do not know if there is a difference between Geneve and vaud but I doubt it.

Thank you! My problem is that the regie sent the bill to me and not to my insurance even I passed them my insurance details. I have the impression that they do not want to get in conflict with the insurance and think that involving me they get the money because I simply give up ...

the regie works for the owner of the building. they will try to do the most to not pay, but the owner must have an insurance for damages ( as in my example of the lift)


you do not own the mail box. so, write to the owner if the regie does not want to pay or activate their insurance. ( most likely their is a "franchise" of maybe a few 100 francs and this repair is too little to cover it) so, they try to get you to pay it.
