A very serious question regarding laws and marriage and immigration to Geneva etc. KINDLY HELP!

I have a friend whose fiance is working in the United Nations until 2013 here in Geneva, Her fiance is by no means a Swiss citizen or an actual legal inhabitant of Switzerland, he is an actual diplomat with a diplomatic status.


His girlfriend is American and they want to get married, she came here to marry him in the Etat civil office and they told them that they needed to go to the office of population cantonal and ask for guidance.... so they did and the psychotic middle aged ugly old-maid swiss b1tch at the geneva cantonal office went hysterical almost personal on them because she wanted to marry her diplomat fiance with a 90 day tourist visa.... basically she told her she needed to go to the USA and request a fiance/marriage visa that can take months to process!!!!


My friend called the Swiss embassy in Washington and it comes up, MARRIAGE VISAS DON'T EXIST FOR SCHENGEN AND SWITZERLAND OPERATES UNDER SCHENGEN!!!! so her 90 days free visa waiver program should be ok.


Her fiance besides from being a diplomat is also a European union citizen originally from Czech Republic!!! so I don't see what's the big fuss can be!


Now they are planning to marry in Czech republic and after she gets some permit in that country, she can come over to switzerland.... however her 90 days in schengen are almost over and she will need to go back to the US.... she's on day 86 as we speak!


On the phone after calling the German, French, Italian, Spanish and Czech embassies in the US, they told her to go to Croatia, Ukraine and come back by land into schengen to have a new stamp in her passport but on a Schegen website it says she must stay away from Schengen for 90 days or she will be banned from ever coming! (which is not good considering her future husband is here)


I simply fail to understand what's so damn hard about really guiding people?


 


Geneva is such an international place and so full of international organizations, that I assume these type of things should be quite common, but it seems no body knows what the hell is going on!!!


 


is it really that bad with the swiss beaurocracy for God' sake?


 


My girlfriend has a migraine today and she called me crying, she's my good old college friend and I told her about Glocals, a website full of expats in Geneva who probably know or have been through these type of situations as many for sure brought wives, husbands, fiances and more here, so I promised I would ask here!!!!


 


I really would appraciate some kind of guidance from any one with similar experiences.

I am not sure our case applies to your friend, but here is my 2 cents.


We were not married when my future husband came to Geneva. I followed him on a visitor visa, he has diplomatic status. We stayed in Switzerland till the end of my visitor visa. We went back to our country to get married. I filed for visa at the Swiss embassy in my country, with the marriage certificate. The embassy gave me a single-entry 3 months visitor's visa, during which time I received my carte de légitimation. 


In our case, both of us are of the same nationality. 


I do know of a mixed couple who got married at the civil office in Geneva, but in their case both had CDLs.
