Accident victim has to pay to get another car?

A lady crashed our car (no personal damage / babies not on board thank God).


She invaded our lane and her insurance is assuming all responsibility. But the damage is so bad that the cost or reparation is more than the value of the car, which dates from 2004.


We did the blue form and it was absolutely the lady's fault... consequently, her insurance is the one that is dealing with everything and MY insurance has nothing to do... they are just providing basic information.


We have 2 children that we need send to the creche everymorning so we need the car and not only do we have to take time off to deal with this incident, the other parties' insurance is not likely even to pay us the cost of our second hand car and we will have to pay from our own pockets to get another similar car plus the convenience of dealing with these without a car for now.  


We are taking time off again to seek legal advice from La permanence des avocats, as suggested by the other glocals forum thread on another accident, but any other advice will be useful.

Just to add, advice on how to get fair compensation for a car that cannot be repaired is sought.

I don't have experience of this In Switzerland, so you should certainly get some professional advice, but the way it usually works in European countries is that they will pay you their estimation of "a fair market price" for your car, based on its age, mileage and assumed condition.  This figure can be questioned if you feel they have undervalued it.  You can also reclaim the cost of a rental car for the time between the accident and when the claim is settled along with any other costs incurred.  You can do all of this by yourself; no need for a lawyer unless they are very slow or try to under-pay.
