Can we get a rent reduction due to construction?

I've tried searching in the Tenant's Rights, but have come up empty-handed and a bit confused.


I'm subletting a flat and when I signed the contract there was no discussion or mention about any construction on the building. My flatmate who was already here for several months had similarly not been informed. One day, soon after moving in, I woke up with men standing outside my bedroom window, erecting scaffolding.


That was about two months ago. There has been no communication with us about how long with will go on, but we've been living with windows closed and curtains drawn for months. We live in an apartment building, so it's not just our unit under construction, but the entire building. They have recently begun work on our unit which has led to dirty water leaks through cracks they have created, dust covering everything, us needing to take time off work to be here for workers, and more.


Our question is - is this something that we could realistically/reasonably request a rent reduction on? It wasn't disclosed to us before committing to the sub-let (not clear if the regie had informed the woman we're subletting from either), it is really impacting our daily lives (can't open windows for fresh air/ventilation/etc, can't have curtains open or else zero privacy/plants dying, cleaning up after it is taking up an inordinate amount of our time, etc). For us, I guess it rests mostly on the fact that we didn't know this would be happening before we signed the contract and otherwise would have negotiated the price/taken a different flat.


 


Thanks in advance for weighing in! Neither of us are Swiss (Canadian and Norwegian) and just not sure what the expectations are here. Thanks!

First major information missing from your post is


Are you subletting officially, eg. the regie authorized the sublet in writing to the woman tenant you contracted the apartment to ? If yes, she should give you proof with the copy of the regie letter. Should it be no, think twice before claiming to the regie. Suggest you try to obtain from building neighbors if they were informed or not....
