Endless "SAD Consultation" for Renovated Flat?

In February, a regie accepted my dossier to rent me a flat.  They gave me only a range for the price, and no certainty as to start date because of ongoing renovations.


In March, the regie told me the contract would start 1 May, but could not confirm the nature of the renovations completed or the specific price.


In April, the regie told me the contract would be delayed due to pending review (SAD Consultation) from Geneva's office des autorisations de construire.


We are now at end of May and I've not received the formal contract. The city's website for these consultations -- http://etat.geneve.ch/sadconsult/sadconsult.asp?WCI=frmConnectionHandler -- says that the regie's application is in "Instruction" status, i.e. neither accepted nor rejected.


The regie has said that there's nothing they can do.  From the FAQ on ASLOCA's site, it looks like they deal only with issues concerning signed contracts.


Has anyone been in this situation?  Can you please offer any casual insights into moving the process along, bailing on the flat, or the potential consequences of this hassle for the lease?

I would think since you have not signed any contract yet then it is ok for you to move on assuming you find another contract before they sort things out. Considering how things slow down in July/August that apartment might only be available in September.

I'm not a lawyer, but I assume you can just bail out and move on because:


- you didn't officially agree to any contract


- the original promises the regie made to you didn't materialise


BUT...if you want to maintain a good relationship with the regie, you could call them and tell them that you want the apartment but you can't wait longer, and that you'd still be happy to be updated of when the apt becomes available. They might appreciate the gesture
