Is this fair? Appartment contract deadline reached, regie asked to do check-out in 2 weeks and to leave...

Hi All

Need your advice and comments urgently.

My appartment contract to be ended at the end of this month, which I was not aware until a letter from regie received today, asking for a check-out appointment in 2 weeks...

Without realizing the expiry date, is it possible to ask for renew of the contract, which i thought is done automatically, unless I request for a contract termination?

Does the regie really have the right to push us out?

In the contract there is no clear statement regarding a 'notice period', do I have any rights to stay and renew the contract?

any experience or comments or advices is highly appreciated. many thanks.

Go to Asloca as soon as  you can. Take all documentation with you..

Arrive as early as you can for the Permanace (opening hours on link) as always  a full room.

You'll have to pay to join and it's a yearly subscription 70f and 20f for opening the dossier.

Thanks for all your replies, I will definitely go to L’ASLOCA, but I do not understand the check-out process at Regie. When we need to terminate the contract they ask for a 'notice period', we cannot leave as soon as we want, we need to inform officialy in written and ask for evidence of letter receipt from the post office, but when they see the contract ends it is only about 2 weeks, including a week of Christmas break!

Why not an alternative way to allow us to renew the contract. Do they really have good business? I am also not sure if any successer have been found as no visiters have come to our appartment.

Incredible!

You really need to read your contract. Everything in there. You probably had a 1 year contract that is renewable if no notice from one of the sides. The notice period should be stated in your contract And all other details.

I recommend that you contact ASCOCA without further delay.

The week between Christmas and New Year is something of a holiday week in Geneva when many offices and organizations work shorter hours than usual – and some don’t even operate at all.

So I suggest that you visit ASLOCA straight away to be sure of getting help and advice before Christmas.

All the best, R.

Wish u too bon fête. Don't give up. Fight with Regie. You will only loose if u give up. And don't sign any documents given by Regie without consulting Asloca.

The Regie finally agreed to extend the contract for 5 years BUT, with 15% increase of the monthly rental fee...I am not sure if this is reasonable or, if any way I can charllenge back?

We all know our salary do not increase with 15% in Switzerland...

did they ask you to sign a new contract (bail)? if yes, u can sign and contest (ideally via Asloca) within 30 days of signature.

15% of rental raise seem not logical, specially if they're not planning on doing any major maintenance.

Many thanks Sinan. Asloca has just advised exactly the same as you mentioned.

It is just unbelievable how mess the market here is in Geneva. The Regie dares to really do everything they want!
