Need urgent help to deal with Regie

I know it is not new, but I could not find a relevant thread in forum. Therefore I decided to ask you folks.


I am leaving Geneva and giving away my appartment (contract). I submitted two candidates to regie 3 months in advance, though they requested only one candidate. Both candidates were ready to take the appartment as it is. Regie did not reply to them but kept sending other people to visit my apartment. 


Today I received a letter from Regie saying that they did not retain the candidates that I proposed because one refused and the other is not solvable. And they announce it only now, one month before my deadline. I know that the person who refused contacted Regie several times to know the answerwith no avail.  Now Regie says that I have to provide other candidates, otherwise they keep me obliged to pay for the remaining months of my contract (3 months). Anthey announce it only now, one month before my deadline. 


Is that normal? Any advice? Otherwise I only have one month left before I leave and it stress me a lot. Shall I go through a lawyer? Thanks in advance for your advice! sab

I recommend going to ASLOCA, they will give you a legal advice.

Yes, I can strongly recommend ASLOCA - it will cost about 65chf to join up for the year and 20chf for admin, so 85 for your first calendar year.


However, it is correct that if the candidate that you present does not take the apartment, you are liable to find another candidate. It is also correct that if the candidate is not solvable (at least 3x monthly rent), then again, you have to present another candidate. So unfortunately you are back to square one.


I was in the same position not so long ago and ASLOCA advised me to keep presenting candidates, the more the better, so don't stop at just 2. Advertise your apartment widely, through Glocals, work intranet, etc etc. Also, ASLOCA helped me word the letter with the correct terminology.


It is a stressful time so I wish you the best of luck.

Jane I just contacted a candidate who refused to know the reason. It turned out that the regie only contacted her on 3 May (and she submitted her file on 22 March with no feedback from régie). As she did not know whether she was retained or not she found another apartment. I think that it is regie's fault. As for another candidate, I looked at his dossier as he sent me copies, and his salary is high enough and he is working with an international organisation. Anyway, I will go to ASLOCA I think.
