Rent increases and ASLOCA
Hi everyone,

with regards to rent increases, is there a tolerable amount people put up with before contesting the increase to their regie?  How often and how much can the regie increase? Has anyone ever used ASLOCA? and if so what was the experience like?

Hi divagirl,



This is one of those answers that starts with "it depends".



There are two types of apt. rental contracts now in use. The first (old one) has rent increase/decrease details tied to the mortgage rate. The new one has rent increases tied to the "cost of living index - IPC". You need to know which you have before you do anything. You should be able to see this by looking at the contract (normally the last page).



So rent increases are normally activated either by an increase in the mortgage rate or the cost of living. They should have mentioned the reason(s) and the calculation in the letter that they sent you.



The second reason/aspect is have the owners done any reno work on the building or your apt? If so, this allows a certain increase.



If you are a member of ASLOCA, you can go to them with the rental contract (bail) and the increase details and they will say whether you can object. The other possibility is if you have legal insurance such as Assista, you can go see them and they will probably send you to ASLOCA for the legal work but they will cover the cost.

If you consult ASLOCA you have to pay 5OF for the first visit, but this covers you for the whole year and any other consults you will do with them within that full year. Divagirl, I guess you probably know already, but for those that don’t, there is a ’permanence ‘ each evening in Geneva, open from 17h-18h Mon-Thrs and 12-13h Fri, in the offices in the Rue du Lac where you can go sit and wait your turn for a consultation, (would advise going as early as you can, there is often many who go), or else you can ring and see if you can make an appointment in advance. You may not get the same person on two different visits if you do not ask for them specifically.

I’ve consulted them quite a few times over the years and have found them generally very good. They are willing to dictate/write letters to the regie whilst you are there, when this is necessary, in language that they take notice of, and they will certainly back you up if your rent is not within the correct parameters.

As Verbier says, each time you go, take all paperwork to do with the bail with you and any letters they have sent you..this will save time for everybody.. and if possible prepare yourself in advance to explain the situation as clearly and briefly as possible. That way you get off to a good start.
