Unemployed Living in France worked in Switzerland
Hi,

I unfortunately lost my job last week, and I am wondering if somebody knows how it works with the unemployment insurance? Where do I need to register in France or in Switzerland? I have been living and working in Switzerland for the past three years but recently moved to France?

If anybody knows how this works I would be very grateful for your help.

Hi Ella, Id guess it starts with where your employer has been paying contributions.



Unless you are assigned/delegated from somewhere else into Geneva, then it would be here and would be clearly stated, on your payslips.

Hi Ella, Id guess it starts with where your employer has been paying contributions.



Unless you are assigned/delegated from somewhere else into Geneva, then it would be here and would be clearly stated, on your payslips.

Like posted above, I your now ex-employer is in Geneva, you were paid in CHF, paid your "chomage, 2è pilier, avs" in Geneva, then yes you shoud go to the Swiss unemployment office.

how did this work out? I thought if you lived in France you had to register as unemployed there regardless of how long you had lived in Switzerland?

If you worked in Switzerland, your employer must have been paying for your unemployment insurance (including your share) to the Swiss Chomage. You therefore have to register with the Unemployment Office (in Geneva, office is close to the Rive) to claim for benefits. I hope this helps.

sorry to hear you lost your job.


i believe that there are bi-lateral agreements between CH and France for chomage. as you are a french resident you will be paid by the french unemployment in your town.
inspite of paying-in in switzerland you fall under the jurisdiction of french unemployment law.

it depends on where you have been paying your taxes. if you have been paying them yourself to the swiss authorities, then La Caisse de Chomage will take over. 


if your taxes have been deducted monthly from your payslip and you just filled a french form including the tax deductions (impots a la source) then the ASSEDIC will take over. you need a E301 form (you can easily get it from UNIA, rue Necker) and take the whole file to the Pole Emploi of where you live.


in any case, make sure your employer fills the forms quickly because you wont get paid till all is complete, either side.

Do you actually get the Chomage then if you are a Franco/Swiss Frontalier?


(I mean, what do you get in terms of unemployment benefit from the French authorities?)

The rate would be around 50-60pct of your previous base salary up to the cap around 125000CHF and you would now be taxed in France.

Yes that's exactly my understanding. If you are a frontaliere you will sign on and collect unemployment benefits in France in your home town (or nearest town).

So do I understand correctly that someone working in Geneva but living in France will receive less unemployment each month than someone living in Geneva?  About 57% in France vs 70% in Geneva?? Have I understood that correctly?

Rules are different in France and in Switzerland. The rules of each country apply to each case depending on where do a person lives. In case of France, it is important that you have to register at pole-empli on the Internet or by calling 3949 immediately after you lost your job (even if you still do not have the E301 form from OCE). In other case, they (pole-emploi) start to count your unemployment benefit from the date of the registration. To prevent from losses an immediate action is required.

Since I went through the same situation I can tell you that you will get the benefits of the country you live in and not those of the country where you earnt your money. This means, you will receive a document "Declaration de l'employeur" from your ex-employer. With this document and some of your last pay slips you will have to go to a swiss authority (don't know the name anymore, but it's behind the post office close to Cornavin station). They will take it all and after some days you will get a form from them that confirms that you were employed in CH and how much your salary was.


This document you will need to register with the Pole-Emploi in France. They will calculate your benefits based on your salary. Yes, unfortunately you will receive only 57 % of your last gross salary minus 11 % of various contributions. The remaining 46 % are subject to income tax - you will have to pay this tax the following year.


Concerning health insurance, you will have to contact the Securité Sociale to get basic insurance and a Mutuelle if you wish (I recommend to get one).


With regard to your 2nd pillar, this money will be kept on an "Compte de libre passage". Meaning it will be "frozen" until you find a new job in CH or your retirement.


It's hard, but that's the reality.

Oh, and as Eryk mentinoned, register immediately with the Pole-Emploi! You should know that you won't receive unemployment benefits for the first 10 days after you registered. This means, you will find yourself with approx. 30 % of your last income in the first month of unemployment...
