What can I do? Our flat got robbed - police is not doing anything about it, even though we know who did it

We subletted our flat. We have written contract with the person who subleased.  While the flat was in her possession, it was robbed by her  or someone who she allowed to stay in our flat,  even though on the agreement it states that the flat is only for her use.  Police is not doing anything about it. How is this possible? It's not like its a robbery by someone random. She is clearly responsible for the damages. Why is police letting her get away with this? It's been months and now police says that they misplaced the file and will contact us when they find it? How is this possible...I just can't believe that police works so bad here in Geneva. Will we have to sue her or the police will actually do something about it?

I think that we should all be grateful that the police do not participate in residential rental inventory disputes, which is what this seems to be.


It's not clear from your description whether the "robbery" was a break-in, or simply things missing at the end of the tenancy.  If it was a break-in, your tenant has to handle it with the police, as she was the legal tenant a the time.  If it is simply that things are missing, then this comes down to what inventory record was agreed at the start of the tenancy and how much was lodged as a deposit.


More details would help and, of course, anyone with relevant legal knowledge should feel free to correct me.

Further Questions: Were you insured Olga? Any third party liability (TPL) insurance and also household goods insurance? TPL insurance is mandatory for you and it also applies as separate additional insurance to be contracted by  your sub-tenant. Was it the case.  Andy mentioned you do not give details or describes but failure to have been insured was an unfortunate risk and you cannot turn to anyone except if you can prove that .your furniture/personal objects were robbed. If there was a claim at the police, they will find it. Since you probably paid for the police report you may even hold a report reference number.

Andy and Millard, again thanks for the posts, no it was not a break in, she let someone else use the place, even though on the contract it stated for her use only.  The whole situation is not clear because she lied. At first she said that she lost the keys with the address written on them and someone found the keys and robbed the place, and then she admitted that she let someone else use the place...unfortunately we didn't  have any insurance, yes it's our fault for trusting people....now she is avoiding us....only a few things like tv, sofa were on the contract. The rest of the stuff that was stolen were in the locked closets, which she was not suppose to "pick the locks" to. Funny thing is the closets were locked    back up, with out the key, and pretty much empty. Also drugs were found inside the locked closet....? We do have a police report...but it's been months already and the police seem like they are not doing much about the whole situation...the case keeps getting transferred from one department to another, someone is always on vacation, they don't call back and the last time we tried to contact the person who is handling the case we were told that the case was misplaced? So keep waiting till its found and someone will call...really? Again, thanks for reading my complaints : )

It sounds like a complex case even for you to explain, let alone for someone from the outside to understand.


The police won't do anything.


My advice to you: leave that flat and move to somewhere with less problems, and come to terms with the fact you won't get reimbursed by anyone for the stuff you lost. Sad but true.
