etat de lieu if no regie, private agreement b/ween 2 parties

i have been renting an appartment thru a regie but about 6 months ago the owner asked for us to have a private arrangement instead as the regie was going bankrupt. i agreed but now that i am leaving the apartment she is handling the etat des lieux herself and being excessive in her demands. in this sort of case is it right that she can conduct it (the etat des lieux) herslef rather than an independent person? any ideas?

Was there an original walk-through of the apartment? If so, where is that document from the regie? Who has the security deposit? Did you transfer it to her or is it in escrow?


Your best bet is to join ASLOCA, the renters' association RIGHT NOW. They have English speaking lawyers who can help you.

In the meantime, do NOT sign any document (typically called "convention de sortie") agreeing to her demands.

Thanks for the tips! I have rented the apartment for about 7 years and for the first 6 and a half it was thru a regie and then just the last 6 months or so thru the woman directly. the orginial etat de lieu was done with the regie (I have a copy). The security deposit was trthe apartment for transferred from being in the regie and my name to being in the woman and my name and is in escrow.

This is a long time to have rented an apartment, especially for Geneva standards. Many so-called concerns of the owner probably can and should be put down to 'normal usage.'
